Terms and Conditions

By purchasing a single-ride ticket and/or PASSPORT card ("ticket voucher") you agree to these terms, which form a binding legal contract between the Grafton SkyTour and Aerie's Resort companies ("SkyTour", "Aerie's", "SkyTour/Aerie's") and the ticket holder (“you”).

If you are purchasing or receiving a ticket on behalf of another individual, it is your responsibility to ensure that the person using the ticket is aware of and accepts these terms. By completing a ticket purchase on behalf of another individual you are warranting that you have made the ticket holder aware of these terms and that they have accepted these terms.

 
ADMITTANCE

Your ticket entitles you to admittance to the SkyTour lower (downtown Grafton) and upper (Aerie's) terminals, and to boarding and deboarding a lift chair or gondola car. Any and all other costs associated with your visit to Aerie's, including but not limited to, admission to ticketed SkyTour/Aerie's activities and events, meals, refreshments, travel, and accommodation expenses, shall be borne solely by you. SkyTour/Aerie's, their partner organizations and contacted vendors shall have no liability whatsoever for such costs.

 
PASSPORT

The Grafton SkyTour annual pass, or PASSPORT card, is valid for one full year (365 days) from the date of purchase. Days and hours of SkyTour operation, single-ride ticket prices, and annual PASSPORT renewal fees and terms may be subject to change without notice. The PASSPORT card is non-transferable, non-refundable, and not for resale.

IMPORTANT: PASSPORT USE OR ATTEMPTED USE BY ANYONE OTHER THAN THE REGISTERED CARDHOLDER, AS VERIFIED THROUGH PHOTO ID, WILL RESULT IN EXPULSION FROM THE PREMISES AND/OR REVOCATION OF PASSPORT PRIVILEGES WITH NO REFUND. Additional ID may be required for verification purposes at the sole discretion of SkyTour operators/attendants. Grafton SkyTour reserves the right to deny and/or cancel PASSPORT privileges for any reason, including but not limited to, refusal to follow posted directions and safety rules, endangerment of other passengers or SkyTour staff, or violation of the SkyTour Terms of Service.

CONTACT INFORMATION

You hereby warrant and agree that the SkyTour/Aerie's may add your contact information to their email database for the purpose of SkyTour/Aerie's announcements, promotions and special offers, and follow-up customer service, with the understanding that any such correspondence shall offer the choice to opt out of further emails.

 
USE OF LIKENESS

By entering the SkyTour/Aerie's facilities, and only during your time spent on SkyTour/Aerie's property, you acknowledge and agree to grant SkyTour/Aerie's and their agents permission to photograph, record, and/or capture your likeness and voice, and/or the likeness(es) and voice(es) of any minor children in your immediate custody, for SkyTour/Aerie's marketing and promotional purposes, included but not limited to, use on social media, in online and print promotions, and in other advertisements, without any further approval from you, and without any compensation to you, monetary or otherwise. Granting these rights to SkyTour/Aerie's and their agents includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow third parties usage and dissemination of said media.

 
EVENT AND ACTIVITIES CONTENT

You acknowledge and agree that SkyTour/Aerie's, at their discretion and with little or no advance notice, reserves the right to change any and all aspects of SkyTour/Aerie's-sponsored attractions, activities, and events.

 
SOLICITATION

You shall not solicit business from SkyTour/Aerie's event vendors, exhibitors, agents, guests, or other attendees. Anyone observed soliciting may be ejected from the event and/or the SkyTour/Aerie's property without refund, and may be banned from future events and/or admittance to the SkyTour/Aerie's property, at the discretion of SkyTour/Aerie's and their agents.

 
REFUNDS

SkyTour/Aerie's tickets, PASSPORTS, and event admissions are nonrefundable.

 
LIABILITY

You agree to indemnify and hold the Grafton SkyTour and Aerie's Resort companies and their agents, as well as any SkyTour/Aerie's-sponsored event vendors, exhibitors, and contractors harmless from and against any and all claims, costs, losses, damages, medical and emergency expenses, sickness, death, injuries, or liability, including without limitation reasonable attorney’s fees and costs, whether to property, person, or otherwise, which may be sustained by any person or which may arise while traveling to, entering, accessing, attending, or participating in any SkyTour/Aerie's property, facility, function, activity, amenity, or event.

 
WARRANTIES

The Grafton SkyTour and Aerie's Resort companies provide no warranties on any aspect of the SkyTour attraction and its operations, nor on any SkyTour/Aerie's amenities, activities, and events, or any materials related thereto or offered in conjunction with and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, and timeliness. SkyTour/Aerie's operations, services and event functions are provided on an “as-is” basis. Neither SkyTour/Aerie's nor its affiliates accept any responsibility or liability for reliance by you or any person on any aspect of, or any information provided at or during, said services and event functions.

By purchasing tickets and/or PASSPORTS you hereby accept the Terms and Conditions as stated above.
